These Terms of Use ("Terms") govern your access to and use of the Snow Okami website (the "Site"), operated by Okami Group 合同会社 ("Okami Group", "Snow Okami", "we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. These Terms apply to use of the Site only; the separate Booking Conditions govern any tour you book with us.
1. Who we are
The Site is operated by Okami Group 合同会社, a company registered in Japan and based in Otaru, Hokkaido. References to "Snow Okami" are to the trading brand of Okami Group. Contact details for enquiries are set out in section 11.
2. Information only — no advice
The Site provides general information about Okami Group and its guided ski touring and related services. Its content is provided for general information only and does not constitute professional, legal, medical, safety, or technical advice, and must not be relied on as such. While we take reasonable care to keep the content accurate and current, we make no representation or warranty that it is accurate, complete, or up to date, and you rely on it at your own discretion.
3. Bookings, prices, and availability
Any tour enquiry or booking request made through or arising from the Site is a request only and is not confirmed until we accept it in writing and any required deposit is received. Prices, availability, dates, inclusions, and itineraries shown on the Site are indicative and subject to change until a booking is confirmed. The specific terms that apply to a confirmed booking — including payment, deposit, cancellation, and refund conditions — are set out in our Booking Conditions, which are provided to you at the time of booking and form a separate agreement between you and us. In the event of any conflict between these Terms and the Booking Conditions in relation to a booking, the Booking Conditions prevail.
4. Mountain activities and assumption of risk
Backcountry, side-country, and off-piste ski touring carry inherent and significant risks, including but not limited to those arising from avalanches, terrain, snow and weather conditions, altitude, cold, and remoteness from medical assistance. Nothing on the Site replaces professional guiding judgement, formal safety briefings, or the separate waiver, assumption-of-risk, and medical-disclosure documents you will be required to read and sign before participating in any activity. Information on the Site is general and must not be used as a substitute for appropriate training, equipment, insurance, and qualified supervision. Participation in any activity is conditional on, and governed by, those separate documents.
5. Acceptable use
You agree to use the Site only for lawful purposes. You must not use the Site in any way that breaches any applicable law or regulation; introduces malicious code or attempts to gain unauthorised access to the Site or its underlying systems; copies, scrapes, or harvests data from the Site other than for ordinary personal browsing; or interferes with the proper operation of the Site or any other person's use of it.
6. Intellectual property
All content on the Site — including text, images, photography, video, graphics, logos, the "Snow Okami" name and branding, and the design and arrangement of the Site — is owned by or licensed to Okami Group and is protected by Japanese and international intellectual property laws. You may view and download content for your own personal, non-commercial use only. You may not reproduce, republish, distribute, modify, or use any content for commercial purposes, or remove any proprietary notices, without our prior written permission.
7. Third-party links and services
The Site may contain links to, or integrate, third-party websites and services (for example, booking, payment, calendar, mapping, or e-signature providers). We provide these for convenience and do not control and are not responsible for the content, availability, security, or practices of any third party. Your use of any third-party site or service is at your own risk and subject to that third party's own terms and privacy policies.
8. Privacy, analytics, and cookies
We use cookies and similar technologies on the Site for functionality, website analytics, and marketing measurement, which may include third-party tools such as Google Analytics and the Meta (Facebook) Pixel. Where required, we will ask for your consent to non-essential cookies, and you can withdraw that consent at any time. How we collect, use, and protect your personal information is described in our Privacy Policy.
9. Disclaimers and limitation of liability
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we exclude all warranties, express or implied, in connection with the Site and its use. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
To the fullest extent permitted by applicable law, Okami Group will not be liable for any loss or damage — whether direct, indirect, incidental, or consequential — arising from your access to, use of, or inability to use the Site, or from reliance on any content on it. Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including under the Consumer Contract Act of Japan (消費者契約法); where any limitation in these Terms is found to be unenforceable, our liability is limited to the maximum extent permitted by law.
10. Changes to the Site and these Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. The version published on the Site at the time you use it applies, and the "Last updated" date above shows when it last changed. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
11. Governing law and contact
These Terms, and any dispute or claim arising out of or in connection with them or the Site (including non-contractual disputes), are governed by the laws of Japan and subject to the exclusive jurisdiction of the courts of Japan.
